This policy explains how TOPZEE CAR RENTAL handles personal information in line with the Protection of Personal Information Act 4 of 2013 (POPIA). TOPZEE CAR RENTAL is owned and operated by Miss T.N. Msweli as an individual (sole proprietor) in Cape Town, Western Cape, South Africa.

What information is collected
- Booking details you submit: your full name, email address, phone number, date of birth, residency (South African or international visitor), rental dates and delivery or collection address.
- Driver and identity documents you upload: identity document or passport, driving licence details including the licence issue date, and for international visitors any international driving permit.
- Payment information processed by our payment provider, and payment records such as the transaction reference, amount, deposit and refund status. Full card numbers are never collected or stored by this website.
- Rental records such as odometer readings, fuel levels, mileage, deductions, traffic fines, tolls and any damage or incident reports.
- Messages you send by WhatsApp, email or phone, and standard technical records created by hosting, database and email services when the website is used.
Why it is collected and how it is used
- To check availability, take a booking and confirm your rental.
- To verify that a driver is licensed and eligible to drive the vehicle, as required for insurance purposes.
- To take payment, hold and refund the security deposit, and calculate any deductions such as fuel, excess mileage, fines or damage.
- To contact you about your booking, including confirmations, reminders, date changes, cancellations and refunds.
- To comply with legal duties, including tax and accounting records, insurance claims, and the reporting or redirection of traffic fines to the driver responsible.
Your information is never sold. You are not added to any marketing list by making a booking. Any future marketing will use separate opt-in consent you can withdraw at any time.
Lawful basis for processing
Processing is based on the steps needed to conclude and perform the rental agreement with you, on your consent when you submit a booking or upload documents, on legal obligations such as record keeping and the handling of traffic fines, and on legitimate interests such as protecting the vehicle, preventing fraud and keeping our systems secure. Where consent is the basis, you may withdraw it by emailing the Information Officer; this does not affect processing already carried out or records we must keep by law.
How information is stored and secured
Booking records are stored in an access-controlled database. Identity, licence and payment documents are stored in a private storage area that is not publicly accessible and can only be opened by the business owner through time-limited secure links. Connections to this website are encrypted (HTTPS), accounts are password protected and access is limited to the owner. No online service can be guaranteed completely secure; any compromise of personal information will be handled in accordance with POPIA, including notifying you and the Information Regulator where required.
Who we share information with
Personal information may be shared with the following parties, who are required to keep it confidential and use it only for the purpose it was given:
- our payment provider, which processes card payments, deposits and refunds;
- the website hosting, database and file storage platform serving this website;
- the email delivery service used to send booking notifications;
- our motor insurer and, where relevant, an approved repairer or assessor, in the event of an accident, damage or theft claim;
- the vehicle tracking provider in respect of the tracking device fitted to the vehicle;
- the traffic authorities, where a fine, toll or penalty is incurred during your rental and must be redirected to the driver; and
- our accountant, and the South African Revenue Service or other authorities where the law requires disclosure.
Vehicle tracking
The vehicle is fitted with a tracking device for security, recovery and insurance purposes. Location data may be accessed where the vehicle is reported stolen or missing, where an incident is being investigated, or where the rental terms are breached. It is not used to routinely monitor your movements.
Cookies and tracking technologies
This website does not use advertising or third-party tracking cookies. Only technical storage strictly necessary for the website to work — such as keeping your booking session and, for the owner, a secure sign-in session — is used. You can block or delete cookies in your browser settings, but essential functions may stop working.
Cross-border processing
Some hosting, storage, payment and email providers operate servers outside South Africa, so your information may be processed in other countries. Those providers are selected on the basis that they offer protection comparable to POPIA through their terms and recognised data-protection safeguards.
How long information is kept
Enquiries and unpaid booking requests are kept only as long as reasonably needed to follow up, and expired holds are released automatically. Identity and licence documents are kept for the period needed to complete the rental and deal with any fine, claim or dispute arising from it. Booking, payment and financial records are kept for the periods required by South African tax, insurance and business law, and are then deleted or anonymised.
Your rights
- Ask what personal information is held about you and request access to it.
- Ask for information to be corrected or updated if it is inaccurate.
- Ask for information to be deleted where there is no legal reason to keep it.
- Object to processing, or withdraw consent, where applicable.
- Lodge a complaint with the Information Regulator.

Complaints
Please raise any privacy concern with the Information Officer first so it can be resolved directly. If it is not resolved, you may complain to the Information Regulator of South Africa through its official website at inforegulator.org.za.
